Wbijam Terms of Service

This is the English version of the Wbijam terms of service. The Polish version (wbijam.app/regulamin) is the binding one; this translation is provided for convenience.
In short: Wbijam is an app for arranging real-life meetups with friends. Downloading and using the current version is free of charge. These terms describe the rules of using the app.
1. What Wbijam is and who runs it
Wbijam is a mobile app in which you send your friends a concrete meetup proposal (what, when, where) and they answer with a single tap. The service is operated by Damian Mikła, trading as Workflows Lab, ul. Jana Pawła Woronicza 15/72, 02-625 Warsaw, Poland, Polish tax ID (NIP) 5214091072 and REGON 529999652, referred to as “we”.

2. Account
- You create an account by providing your phone number, confirming it with an SMS code, and giving your first name.
- You must be at least 18 years old.
- The account is personal: you create it for yourself and provide your own number plus a name or nickname you use.
- You are responsible for what happens on your account. Do not share your login codes with anyone.
3. Rules of use
Wbijam is for arranging meetups with friends. When using the app you agree that you will not:
- impersonate other people,
- use the app for spam, harassment, or breaking the law,
- include unlawful, offensive, or rights-infringing content in proposals,
- create, send, or distribute content or conduct involving child sexual abuse and exploitation (CSAE), including child sexual abuse material (CSAM), grooming a child for sexual purposes, sexual extortion, or sexualising a minor,
- attempt to disrupt the app or gain access to other people’s data.
If someone breaks these rules, we may suspend or delete their account. Where possible, we will warn first and give a chance to explain.
Zero tolerance for abuse. Offensive content and harassment are not allowed. For every proposal you receive, you can report the content or block the person. We prioritize reports. After review, we may remove content, restrict access, or suspend or delete an account that violates these terms.
Child safety. Content and conduct involving child sexual abuse and exploitation are strictly prohibited. After receiving a credible report, we act without undue delay: we block access to the content, restrict or delete the account, and refer the matter to Dyżurnet.pl, law enforcement, a public prosecutor, or another competent authority when required by law or necessary to protect a child. We may act immediately without prior warning. The child-safety point of contact is Damian Mikła, kontakt@wbijam.app.
4. Your content
The content you create in Wbijam (proposals, answers) belongs to you. You grant us only a non-exclusive license to the extent necessary to operate the service, e.g. to display your proposal to the people you yourself invited. We do not use your content for anything else.
5. Service availability
The current version of Wbijam is free of charge and under active development. So, honestly:
- we do not guarantee uninterrupted or error-free operation of the app,
- features may change, appear, and disappear,
- we may discontinue the service for an important reason, such as a legal or security requirement or permanent product withdrawal. We will provide the information required by law and enable you to exercise your applicable rights.
6. Meetups happen in real life
Wbijam helps you make the plan, but the meetup itself is organized by you and your friends. The participants are responsible for how meetups go, for getting there, costs, and everything that happens outside the app.
7. Liability
To the fullest extent permitted by law, our liability for damage arising from the use of this free app is limited to cases of willful misconduct and gross negligence. Nothing in these terms excludes or limits the rights you have as a consumer under mandatory provisions of law.
8. Reports
If someone violates these terms, use “Report proposal” in the app or write to kontakt@wbijam.app. You can also send general feedback from Settings through “Tell us what you would change”. We respond to reports and complaints within 14 days. We handle child-safety reports without undue delay.
9. Ending your use
- You: can delete your account in the app at any time (Settings → Delete account). Your data will be deleted in accordance with the privacy policy.
- We: may suspend or delete an account that violates these terms (section 3) or discontinue the service (section 5).
10. Changes to the service and these terms
We may change the service or these terms for justified reasons: changes in law, security, abuse prevention, technical or organisational changes, or feature development. A change will not impose an additional cost on you. We will explain it clearly and in a manner appropriate to its significance.
If a change materially and negatively affects access to or use of the service, we will notify you with reasonable advance notice on a durable medium about the change, its effective date, and the rights available to you under applicable law. If a new use of personal data requires consent, we will ask for it before that use begins.
11. Law and disputes
These terms are governed by Polish law. This choice of law does not deprive you of the protection granted by provisions that cannot be derogated from by agreement in the country of your habitual residence. We will first try to resolve disputes amicably; court jurisdiction is determined by generally applicable law.
